You can now listen to Fox News articles! New York Attorney General Letitia James is set to appear in federal court in Norfolk, Virginia, Friday morning for the start of a two-count indictment trial stemming from statements she allegedly made about the nature of a second home she purchased in 2020. The indictment follows the firing or resignation of several officials who have since pushed back against the charges. She faces two federal counts of bank fraud and making false statements to a financial institution. The charges stem from her 2020 purchase of a home in Norfolk, Virginia, where prosecutors allege she misled a bank about the nature of the occupancy in order to secure more favorable loan terms. For her part, James has vehemently denied any wrongdoing and is expected to plead not guilty. She added: “These charges are baseless, and the president’s public statements make clear that his sole objective is political retaliation at any cost.” Her indictment, like that of charges against FBI Director James Comey, were presented to a grand jury by Lyndsey Halligan, a former White House aide who was appointed by Trump as the acting U.S. Attorney for the Eastern District of Virginia last month. Trump said in September that he would appoint Halligan to the top U.S. Attorney post for the Eastern District of Virginia, replacing interim attorney Eric Siebert, who resigned amid pressure to charge both Comey and James. 6 INVESTIGATIONS New York Attorney General Letitia James speaks during a press conference on September 21, 2022, in New York. (AP Photo/Brittany Newman, File) The indictments against James, like the Comey charges, stoke fears of retaliation and weaponization within the ranks of the Justice Department during Trump’s second term. In both cases, it prompted the resignations or firings of several career officials in the Eastern District of Virginia, including the Norfolk office, where two assistant U.S. attorneys were fired for objecting to the James indictment. Halligan will be joined in court Friday by Roger Keller, a Missouri-based federal prosecutor, according to court filings. James’ defense attorney, Abby Lowell, told the court that they have retained the services of Andrew Bass, a Norfolk-based former assistant U.S. Attorney who previously served as the chief of the office’s criminal division. The case against James comes after she successfully sued President Donald Trump for civil fraud last year. Following the subpoena, she will likely file a motion to dismiss her case for retaliation and selective prosecution, following similar steps taken earlier this week by Comey’s legal team in Alexandria. Her lawyer, Lowell, has called the case against her “an inappropriate act of political retribution” and vowed they would “fight these charges through every process afforded by law.” Brynn Depesch is a Fox News Digital national politics reporter covering the Trump administration, focusing on the Justice Department, FBI and other national news.
